La Bella Rosa Studios – Online Shop for Art Prints

1. Scope of Application
1.1 These Terms and Conditions (AGB) apply to all contracts concluded via our online shop between La Bella Rosa Studios, Owner: Nadine Zech, c/o MDC#zech, Welserstraße 3, 87463 Dietmannsried, Germany (hereinafter “we” or “us”) and you as the customer (hereinafter “customer” or “you”) in the version valid at the time of the order.
1.2 Deviating terms and conditions of the customer will not be recognised unless we expressly agree to their validity in writing.
2. Contracting Party, Conclusion of Contract
2.1 The purchase contract is concluded with La Bella Rosa Studios, Owner: Nadine Zech.
2.2 The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. You may first place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order. By clicking the order button, you submit a binding offer to conclude a purchase contract for the goods contained in the shopping cart.
2.3 After placing the order, you will receive an order confirmation by email. This does not yet constitute acceptance of your offer. The contract is only concluded when we expressly declare acceptance (e.g. by means of an order confirmation by email) or when we dispatch the goods to you (shipping confirmation).
3. Contract Language, Storage of Contract Text
3.1 The language available for concluding the contract is German.
3.2 The Terms and Conditions (AGB) can be accessed on our website at any time.
4. Prices and Terms of Payment
4.1 The prices indicated are final prices. In accordance with Section 19 of the German Value Added Tax Act (UStG), no VAT is charged and therefore not shown separately (small business regulation).
4.2 Shipping costs may be added to the product prices. You will be informed about the amount of shipping costs during the order process.
4.3 The following payment methods are generally available to you: credit card, PayPal, instant bank transfer as well as other payment methods indicated during the order process.
4.4 Payment is due immediately upon conclusion of the contract.
5. Delivery, Availability of Goods
5.1 Delivery will be made to the delivery address specified by the customer worldwide, unless country-specific exclusions apply (details during the order process).
5.2 We use a specialised print-on-demand service provider (Prodigi) for the production and shipment of your order. Depending on the destination country, production and shipment may take place at various production locations worldwide, in particular in the European Union, the United Kingdom, the USA and Australia. The delivery time is indicated in the online shop and starts after receipt of payment.
5.3 Should an ordered product exceptionally not be available, we will inform you without delay. Any payments already made will be refunded immediately in such cases.
5.4 For international deliveries outside the European Union, additional customs duties, taxes or fees may be incurred. These are borne by the customer and levied by the respective customs or tax authorities. We have no influence over these costs.
5.5 For deliveries to certain countries, there may be extended delivery times, import restrictions or additional official requirements. As far as delays are due to circumstances beyond our control and which we could not prevent even with reasonable care – in particular official measures, customs obstacles or force majeure – we are not liable for such delays. Liability for intent and gross negligence as well as for the breach of essential contractual obligations (cardinal obligations) remains unaffected; in the latter case, liability is limited to the typically foreseeable contractual damage.
5.6 The delivery period consists of production time and shipping time and begins after receipt of payment.
5.7 As the products are individually produced only after you have placed your order, changes or cancellations are generally no longer possible once production has started. If you have any concerns, please contact us as soon as possible immediately after placing your order. The statutory right of withdrawal for consumers with habitual residence in the EEA (Section 7) remains unaffected by this provision.
5.8 Due to the print-on-demand process and device-dependent screen displays, slight, technically induced variations in colour or contrast compared to the online representation may occur. Such variations within the scope of usual printing tolerances do not constitute a substantial defect. Statutory warranty rights remain unaffected.
6. Retention of Title
The goods remain our property until full payment has been received.
7. Right of Withdrawal for Consumers
7.1 Scope of the Right of Withdrawal
The following right of withdrawal applies exclusively to consumers within the meaning of Section 13 of the German Civil Code (BGB) who have their habitual residence in a member state of the European Economic Area (EEA). For orders placed by customers with habitual residence outside the EEA – in particular from the USA, Canada, Australia or the United Kingdom – no contractual right of withdrawal exists, unless mandatory local consumer protection law provides otherwise.
For consumers with habitual residence in the United Kingdom, the provisions of the Consumer Contracts Regulations 2013 apply, insofar as these are mandatorily applicable.
Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.
7.2 Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

of your decision to withdraw from this contract by means of a clear declaration (e.g. by email or letter). You may use the model withdrawal form (see Section 7.3), which is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
7.3 Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received your communication of withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged fees for this repayment.
We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever is earlier. Please note that the goods can only be inspected after they have been received by us.
You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. The return of the goods must be addressed to:

You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

8. Warranty and Liability
8.1 Statutory warranty rights for defects apply.
8.2 The customer’s claims for damages are excluded unless they relate to damages arising from injury to life, body or health or from the breach of essential contractual obligations (cardinal obligations), as well as to other damages based on an intentional or grossly negligent breach of duty.
8.3 Obvious transport damage should be reported immediately to the carrier and we should be informed without undue delay. Failure to lodge a complaint does not affect your statutory warranty rights.
8.4 We kindly ask you to document obvious defects or transport damage as soon as possible, ideally within 7 days of receiving the goods, by sending us a photo and informing us. Failure to provide such notification does not affect your statutory warranty rights.
9. Copyright
All designs, illustrations and motifs offered are protected by copyright. Any reproduction, distribution or commercial use is not permitted without our express written consent.
10. Dispute Resolution and EU Commission’s Online Dispute Resolution Platform (ODR Platform)
The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
11. Applicable Law
German law shall apply under exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer and have your habitual residence in another country, the mandatory consumer protection provisions of that country remain unaffected.
